Terms of Service

These Terms of Service ("Terms") are an agreement between you and NovelMonkey AI Lab ("we", "us"), which operates the Nook desktop and mobile apps and the website at getnookai.com (together, "Nook"). By using Nook, you agree to these Terms, our Privacy Policy, our Refund Policy and our Content & Safety Policy.

1. Adults only

You must be at least 21 years old to use Nook. You give your date of birth when you set up your account, and Nook cannot be used by anyone under 21. By using Nook you confirm that you meet this requirement and that viewing mature AI-generated content is legal where you are. We close accounts we believe belong to anyone under 21.

2. What Nook is

Nook is an entertainment product. You talk with fictional AI characters, and everything they say and do is generated automatically by artificial intelligence as text, voice and video. Characters are not real people. Replies may be inaccurate or unexpected and are not professional, medical, legal or financial advice. If you are in crisis, contact local emergency services.

3. Your account

You sign in with a Google account. You are responsible for activity on your account and for keeping your sign-in secure. One person per account; do not share, sell or transfer accounts.

4. Acceptable use

You agree to follow our Content & Safety Policy. In particular, you may not use Nook to create or request content involving minors, non-consensual acts, real and identifiable people, or anything illegal. You may not try to bypass our safety systems, reverse-engineer the service, resell access, or use automated tools to access Nook. We may block requests, remove content and suspend or close accounts that break these rules.

5. Diamonds and purchases

• Talking with characters is paid for with diamonds, a virtual item. What each kind of reply or call costs, and current pack prices, are shown on the Pricing page.
• Diamonds are a limited license to use Nook features. They have no cash value, cannot be exchanged for money, and cannot be transferred between accounts.
• Diamonds are deducted when you send a message, request a video reply, or at the start of each minute of a video call. If a reply fails because of a problem on our side, the diamonds are returned automatically.
• Diamond packs are one-time purchases. There are no subscriptions and no automatic renewals.
• Payments are processed by Stripe. Your payment is also subject to Stripe's terms.
• We may change prices for future purchases. Changes never affect diamonds you have already bought.
• Free diamonds we give you (for example when you sign up, or daily during the beta) can be changed or ended at any time.

6. Refunds

Refunds are handled under our Refund Policy. Please contact us before filing a chargeback so we can resolve the problem quickly.

7. Content and intellectual property

Nook, its characters, artwork, voices, software and generated media are owned by us or our licensors. We give you a personal, non-commercial, revocable license to use Nook and to view replies generated for you. You keep any rights you have in the messages you send, and you give us permission to process them to provide and improve Nook as described in our Privacy Policy.

8. Termination

You may stop using Nook and ask us to delete your account at any time, as described on Delete your data. We may suspend or close your account if you break these Terms. If we close your account without cause, we will refund diamonds bought in the previous 30 days that you have not used. Accounts closed for breaking these Terms are not refunded.

9. Disclaimers

Nook is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. We do not guarantee that Nook will be uninterrupted or error-free.

10. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special or consequential damages, and our total liability for any claim relating to Nook is limited to the amount you paid us in the 12 months before the claim.

11. Governing law

These Terms are governed by the laws of the place where NovelMonkey AI Lab is established, without regard to conflict-of-law rules. Disputes will be resolved in the courts located there, unless the law where you live requires otherwise.

12. Changes

We may update these Terms. We will post the new version here with a new effective date and, for material changes, notify you by email or in the app. Continuing to use Nook after changes take effect means you accept them.
